The Child and Adult Protection Authority (CAPA/KESB) is an institution for the protection of persons who are incapable of acting. It acts on appeal or ex officio where a person is presumed to be incapable of judgment. If this person has issued an advance care directive, the CAPA examines it and makes the valid dispositions stipulated therein. If there is no advance care directive, the CAPA may still act in the interests and for the protection of the person. As a social welfare institution, the CAPA has no connection with a death unless the deceased person was already receiving assistance during their lifetime.
